Terms of Service

1. Acceptance of Terms

By accessing or using the My Chitram platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the Service. These Terms apply to all users including administrators, company admins, and end users.

2. Account Registration

You must provide accurate and complete information during registration
You are responsible for maintaining the security of your account credentials
One email address may be associated with multiple accounts across different companies
Company administrators are responsible for managing users within their organization
We reserve the right to suspend or terminate accounts that violate these Terms

3. Acceptable Use

You agree NOT to:

Use the Service for unauthorized surveillance, stalking, or harassment
Upload illegal, offensive, or infringing content
Attempt to reverse-engineer, decompile, or extract the AI face-matching models
Share event passcodes with unauthorized individuals
Use automated tools or bots to access the Service without prior written consent
Circumvent or disable any security features of the platform
Upload photos of individuals without their knowledge or consent
Resell, sublicense, or redistribute the Service without authorization

4. Payment Terms

4.1 Billing

My Chitram offers two billing models: (1) Subscription Plans billed monthly or annually in advance, and (2) Event Plans billed as a one-time charge per event with no recurring fee. All prices are in USD. Applicable taxes will be added at checkout. Payment is due upon invoice generation. Continued use constitutes agreement to applicable fees.

4.2 No Refund Policy

IMPORTANT: NO REFUNDS

All payments made to My Chitram are non-refundable. This includes subscription fees, plan upgrades, and any add-on purchases. By subscribing, you acknowledge and agree to this no-refund policy.

4.3 Late Payments & Suspension

If payment is not received within 10 days of the due date, we reserve the right to suspend access. Accounts with overdue payments exceeding 30 days may be terminated, and associated data may be deleted after an additional 30-day grace period.

4.4 Plan Changes

Plan upgrades take effect immediately with prorated billing. Plan downgrades take effect at the start of the next billing cycle. Downgrading may result in loss of access to premium features including Design Studio layouts, Watermark & Branding, and AI enhancements.

5. Facial Recognition Consent

By using My Chitram face recognition features, you acknowledge and agree that:

Your facial photographs will be processed using proprietary AI technology for identification
Processed face signatures will be used to identify you in event photos and for login verification
You have the right to withdraw consent and request deletion of facial data at any time
Event organizers may use the Service to facilitate photo distribution based on facial matching

5.1 Photo Deletion Policy

IMPORTANT: Permanent Photo Deletion

All photo deletions are permanent and irreversible. Once deleted by a user or administrator, photos are permanently removed from our servers and cannot be recovered. If your subscription expires and photos are deleted, resubscribing will NOT restore them. Always back up photos before deletion or plan expiry.

6. Gallery Design & Watermark Features

My Chitram provides a Design Studio for gallery customization and a Watermark & Branding tool for photographers. These features are available on Pro and Enterprise plans. Watermark and branding settings are applied at the event level and are processed at photo delivery time. We do not guarantee watermark placement on all device/browser combinations.

7. Content Ownership

You retain ownership of all photos and content you upload to My Chitram. By uploading content, you grant us a limited, non-exclusive license to process, store, and display your content solely for the purpose of providing the Service.

8. Service Availability

We strive to maintain continuous availability but do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue any part of the Service with reasonable notice. Scheduled maintenance will be communicated at least 48 hours in advance.

9. Account Suspension & Blocking

We reserve the right to block or suspend accounts for:

Violation of these Terms of Service
Suspicious or fraudulent activity
Non-payment of subscription fees
Uploading illegal or harmful content
At the request of the company administrator

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, My Chitram shall not be liable for any indirect, incidental, consequential, or punitive damages. Our total aggregate liability shall not exceed the fees paid by you in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless My Chitram, its officers, employees, and partners from any claims, losses, or damages arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

12. Modifications to Terms

We may update these Terms from time to time. Material changes will be communicated via email or platform notification at least 14 days before taking effect. Continued use constitutes acceptance of the revised Terms.

13. Governing Law & Dispute Resolution

These Terms shall be governed by applicable law. Any disputes arising from these Terms or the use of the Service shall be resolved through binding arbitration.
